Includes logos, flyers, brochures, posters, advertisements, newsletters, business cards, postcards and other marketing collateral for profit or non-profit purposes.
Within your giving time frame of receiving your personal/company information TRFQGS will create a design concept for your project. Designs will be submitted for your review via E-mail/text/message unless otherwise negotiated. A personalized proposal will be submitted to the client that includes details on how many revisions will be included for the estimated cost if needed. Any & all artwork that is completed is a NO REFUND due to completed artwork. If artwork is not started a refund is liable once negotiated. Total project fees may be negotiated in lieu of a design cover fee & extra charges upon request.
Both (me) and (you) the client have full ownership of the final design for use in any media application that is beneficial to the business. TRFQGS retain the right to use the final design, or any versions of the design created in the process, within printed and online portfolios, including promotional materials such as newsletters and advertisements. The client also gives TRFQGS permission to use client’s name, business address and/or website address, for testimonial purposes on our website, or other business related media. The client understands that it is the client’s responsibility to copyright the design (www.copyright.gov) and/or seek trademark (www.uspto.gov/main/trademarks.htm).
In return for Digital Design services, the client agrees to pay the total fee payable in one payment. A FULL deposit is required before any work begins and when final design is complete, a print approval is verified to the customers request. In the event of termination of this Agreement, TRFQGS owns the artwork if not payed for and has the right to complete, exhibit, and/or sell the artwork design (not including business name). Furthermore, The client understands that once the final invoice is paid in full, the client has the right to use the design in all media useful for business promotion and that TRFQGS reserves the right to display the design for their own promotional use.
TRFQGS affirms that all designs are original and therefore owns the rights granted under this agreement, and that the rights granted do not conflict with any other agreement.
Illness, injury, shipping or other events beyond TRFQGS control, such as: fire, theft, computer failure, and any other acts of life may result in a delay of unpredictable length.
The client has the right to terminate this agreement if, TRFQGS fails to complete the design by any deadline that has been submitted and agreed upon in writing only if the artwork has not been completed. If agreement is terminated for any reason other than failure to deliver within agreed-upon timeframe, TRFQGS shall retain the deposit.

TRFQGS does not warrant that the functions supplied by design(s), consultation or advice, will be uninterrupted or error-free. The entire risk as to the quality and performance of the design is with client. In no event will TRFQGS be liable to the client or any third party for any damages, including any lost profits, lost savings or other incidental, consequential or special damages arising out of the printing, reproduction of, or appearance of the design, even if TRFQGS has been advised of the possibility of such damages.
